Litigation support
Most cases settle, and expert work is why they settle where they do
Expert evidence is usually framed as preparation for trial. In practice its main effect is on the number both sides will accept without one.
The mechanism
What changes an agency position
Right of way staff settle against risk. A file containing a credible independent appraisal, a traffic study showing the access problem and an engineer’s estimate that the proposed cure costs twice the allowance is a file their own reviewers will look at seriously. Most agencies have internal authority to settle above the appraised figure where there is a documented reason.
The reverse is also true. A file containing nothing but an owner’s dissatisfaction gives the agency no basis to move, even where the staff privately agree the offer is thin. They need something to write down.
The question worth asking the agency directly is what they would need in order to move. It is usually answered honestly, and the answer is usually a specific piece of evidence rather than a negotiation.
Where it happens
The three settlement windows
Before filing
After an independent appraisal and a supported counteroffer. The cheapest settlement available, and it requires evidence to exist early.
After exchange of expert reports
Each side now sees the other’s case. A large proportion of condemnation matters resolve here.
After depositions
Each side has seen how the other’s evidence performs under pressure, which is usually the last missing piece.
Forms
What expert support looks like in settlement
| Form | Use |
|---|---|
| Independent appraisal | The competing number the negotiation needs |
| Appraisal review | A specific methodological criticism the agency can act on |
| Engineering estimate | Demonstrating the proposed cure is underpriced or unbuildable |
| Traffic analysis | Converting an access assertion into a measured fact |
| Mediation presentation | Technical evidence made legible to a mediator in an hour |
| Sensitivity analysis | Showing how the figure moves on each disputed assumption, which is often what frames a deal |
Questions about settlement
Will the agency pay my expert costs
In most states each side bears its own. Some states shift fees where the award beats the offer by a margin, which changes the whole calculation and should be checked at the outset.
Is it worth retaining experts if we intend to settle
That is precisely when it is worth it. Settlement figures track evidence, and evidence is what experts produce.
Can experts attend mediation
Often, and it can be effective. A mediator who understands the technical dispute moves the parties better than one working from competing assertions.
The expert decides the number more often than the argument does
In condemnation the facts in dispute are technical. Who presents them, and how well, is usually what the case turns on.
