Expert category
Eminent domain expert witnesses
The primary category. A taking can put valuation, engineering, planning, access, environment and business loss in issue at once, and the case is decided by whichever of those the parties fight over.
Scope
The questions this expert answers
What is just compensation here
The compensation figure itself, which in a partial taking is the before value less the after value.
Is the agency appraisal defensible
Appraisal review under the applicable standard, testing method and support rather than substituting a number.
What did the taking do to the remainder
Severance damages, the item most often concluded as nil without analysis.
Can the remainder still be used as it was
A planning question about entitlement and compliance, not a valuation one.
Does the surviving access work
Measured with swept paths and sight distance rather than asserted.
Will the opinion survive
Deposition, cross examination and admissibility.
Selection
What to check before engaging
| Criterion | What to look for |
|---|---|
| Condemnation volume | Assignments in this field specifically, in the last three years, in this state |
| Jurisdiction | Familiar with the measure of compensation and the procedure where the case sits |
| Testimony record | Has testified, and recently. An expert never cross examined is an unknown quantity |
| Federal standards | Yellow Book experience where the project carries federal funding |
| Independence | No contingent fee, which professional standards prohibit, and no conflict on this project |
| Scope discipline | Stays inside their qualification and relies on others for the rest |
In practice
One case, several disciplines
Owners and counsel tend to look for an eminent domain expert as though it were a single profession. It is not. The appraiser states the number, and the number rests on facts the appraiser is not qualified to establish: whether the remainder can be developed, whether the new grade can be reached by a loaded vehicle, whether the surviving entrance works for the use.
Cross examination follows that seam. Counsel does not attack the conclusion, they attack the assumptions beneath it, one qualification question at a time. An appraiser who can point to a planner, an engineer and a traffic report has a foundation. One who cannot has conceded that the valuation rests on assumptions they were not entitled to make.
So the useful first question is not who is the best appraiser. It is which assumptions in this valuation sit outside the appraiser\u2019s field, and who is qualified to supply each of them.
Listed experts
Experts in this category
The directory is being built. Experts practising in this category can write to editorial@eminentdomainexpertwitness.com. Listing is free, requires evidence of credentials and condemnation experience, and is not sold.
In the meantime, how to find an expert sets out the four routes that reach the same population, and the questions worth asking before you engage anyone.
Questions about this category
Can one expert cover the whole case
In a straightforward partial taking, often yes. The trigger for adding disciplines is any assumption the appraiser cannot personally support.
When should experts be retained
Early enough to shape the record rather than comment on it. Supporting conclusions have to exist before the appraisal is written, not after.
Who pays for all this
In most states each side bears its own costs, so fees come out of the recovery. A minority shift fees where the award beats the offer by a margin, which changes the calculation entirely.
Is a consulting expert discoverable
Generally not, which is why early assessment is often done in a consulting capacity before anyone is designated. Rules vary and the distinction should be set at retention.

Real Estate Damages
Diminution in value, severance damages, cost to cure, lost rent and the loss that remains after a proposed cure.

Entitlement probability, zoning compliance after a taking, and whether the remainder can still be developed for the use it was valued on.
Land Surveying
Boundaries, easements, encroachments, right of way plans and the survey evidence a partial taking turns on.
Utilities and Corridors
Transmission lines, pipelines and utility corridors: easement scope, depreciation and the value of rights rather than title.
The right expert is the one whose field actually covers the dispute
Start from what is contested, not from a list of names. The category pages explain which discipline answers which question.
