Utilities and corridor expert witnesses

Transmission lines, pipelines and utility corridors take rights rather than title. What the easement document permits the holder to do decides most of the value, and it is read less often than the plan is.

Scope

The questions this expert answers

What percentage of fee value does this easement take

A judgement driven by the document, not by a customary figure.

What does it do beyond the corridor

A line across the middle of a development parcel can sterilise the land either side of it.

What is the utility asset itself worth

Where the taking acquires plant rather than land, specialised valuation applies.

Is the restriction permanent or for the works

A temporary construction easement is rent for the term plus restoration, which is a different calculation.

What does relocation cost

Wells, septic, irrigation and services that must be moved for the corridor to work.

Does the market price the perceived risk

On residential land near a pipeline or a transmission line it frequently does, and comparable sales show it.

In practice

Four ways easement valuations understate

Valuing only the strip, as though the restriction stops at the corridor boundary. Applying a conventional percentage of fee value without reading what this particular grant permits. Ignoring assignability, so an easement the holder may transfer or expand is priced as though fixed. And treating a temporary easement as permanent, or a permanent one as temporary.

The encumbrance rarely stops at the corridor. Where a route crosses a development parcel, the damage is the layout it makes impossible, and that belongs in the after value rather than in the strip.

Listed experts

Experts in this category

The directory is being built. Experts practising in this category can write to editorial@eminentdomainexpertwitness.com. Listing is free, requires evidence of credentials and condemnation experience, and is not sold.

In the meantime, how to find an expert sets out the four routes that reach the same population, and the questions worth asking before you engage anyone.

Questions about this category

They say I keep ownership, so why pay much

Because ownership without the right to use the land has limited value. A restrictive perpetual easement can take most of the value of the affected area.

Can I still farm the easement area

Often, depending on terms. The valuation should reflect whatever use genuinely remains, no more and no less.

Is a temporary construction easement worth arguing about

Yes, if the area is in use. It is rent for the period plus restoration, and on a commercial yard or a working farm that is not trivial.

The right expert is the one whose field actually covers the dispute

Start from what is contested, not from a list of names. The category pages explain which discipline answers which question.
