Land surveying expert witnesses

Boundaries, easements, encroachments and right of way plans. In a partial taking the survey is the evidence of what is being acquired and what is left, and it is read far less carefully than it deserves.

Scope

The questions this expert answers

What is actually being taken

Area, location and interest, read off the right of way plans rather than the offer letter.

Where is the boundary

Retracement from the record, which occasionally finds that the agency is acquiring land it already owned, or missing land it does not.

What burdens the remainder already

Existing easements and restrictions that affect what the remainder can still be used for.

Is anything encroaching

Structures, drives and fences that cross a line, which the taking can convert from a private matter into a compensation question.

What does the plan actually show

Cross sections, grades and work limits that no narrative in the file mentions.

How big is it really

Area calculations, where an error propagates directly into the award.

In practice

The plans contain the facts nobody narrates

Counsel can read correspondence. What counsel generally cannot do is look at sheet 14 of a construction drawing set and see that the finished grade at the property boundary sits four feet above the existing driveway, or that the drainage design discharges across the remainder.

Those findings are not in any narrative. They are in the drawings, and a surveyor or engineer reading the plan set early routinely finds the most valuable facts in a condemnation case.

Experts in this category

The directory is being built. Experts practising in this category can write to editorial@eminentdomainexpertwitness.com. Listing is free, requires evidence of credentials and condemnation experience, and is not sold.

In the meantime, how to find an expert sets out the four routes that reach the same population, and the questions worth asking before you engage anyone.

Questions about this category

Do I need a surveyor if the agency supplied plans

Their plans were prepared for their purpose. An independent read costs little against the chance of an area error or an unnoticed grade change.

Can a surveyor give an opinion on value

No. They establish the physical and record facts. The valuation conclusion belongs to the appraiser, who relies on the survey.

What if the agency boundary is wrong

It happens, and it is worth checking before anything is agreed. A retracement is cheap relative to the compensation it can affect.

The right expert is the one whose field actually covers the dispute

Start from what is contested, not from a list of names. The category pages explain which discipline answers which question.
