Traffic evidence: whether the property still works
Access harm is the most common severance damage in corridor projects and the easiest to assert without proof. Traffic engineers convert the assertion into measurements.
Scope
The questions this expert answers
Can the vehicles still get in
A swept path drawing showing a delivery vehicle before and after is the single most persuasive exhibit in many access cases.
Is the new entrance safe and usable
Sight distance, grade and alignment determine whether a relocated access is equivalent or merely nominal.
Does the site still circulate
Internal movement, loading and turning often matter more than the entrance itself.
Is this impairment or inconvenience
The legal line between compensable impairment and non compensable circuity needs factual content on the impairment side.
What does the project actually do
Reading the agency traffic analysis for effects on this property that nobody flagged.
How much parking is really lost
Count, dimensions, aisle width and ordinance compliance after the taking.
Selection
Qualifications and what to check
| Criterion | What to look for |
|---|---|
| Credentials | Licensed professional engineer with traffic specialism, or equivalent certification |
| Software and method | Swept path analysis, sight distance to the applicable standard, documented method |
| Corridor experience | Has worked on projects of this type, ideally on both agency and owner sides |
| Exhibit quality | Produces drawings a jury can read, which is much of the value |
| Standards | Works to the recognised design standards the agency itself applies |
In practice
The distinction that decides these cases
Most jurisdictions compensate substantial impairment of access and do not compensate circuity of travel. The line is real and it is where access claims are won and lost.
An owner saying customers now have to drive further is describing circuity, which is shared with everyone on the road and is almost never compensable. An owner demonstrating that a thirty eight foot delivery vehicle can no longer enter, turn and leave without reversing onto a highway is describing impairment, and the evidence for it is a drawing rather than an opinion.
Traffic experts matter because they move the claim from the first category to the second, where the facts support it.
Questions about this expert
Is a median closure compensable
Usually not, if your own driveway is untouched. It is generally treated as traffic regulation rather than a taking of access, however severe the commercial effect.
My driveway is being moved thirty feet
Then the question is whether the new location is equivalent. Grade, sight distance and turning geometry decide it, and all three are measurable.
Does this apply to residential property
Less often. Access claims are mostly commercial, industrial and agricultural, where the use depends on particular vehicle movements.
The expert decides the number more often than the argument does
In condemnation the facts in dispute are technical. Who presents them, and how well, is usually what the case turns on.
